The qualified extension of the deadline for compliance with the Promotion of Access to Information Act (PAIA) merely a day before its expiry certainly was to be welcomed. Yet, we at Aucamp Scholtz Lubbe, are of the opinion that affected companies should not construe this as a signal to put the matter on hold for the duration of the extension period.
In an eleventh hour government intervention Mr Jeff Radebe, Minister of Justice and Constitutional Development, announced on 30 December 2011 that the deadline of 31 December 2011 in certain instances had been postponed to 31 December 2015
Although this officially constitutes a breather of four years, we deem it feasible for companies to compile and submit the required PAIA documentation to the Human Rights Commission at the earliest possible opportunity, and to update the content thereof on an annual basis, should any changes occur.
Having compiled and submitted all the relevant PAIA manuals to the said commission prior to the original deadline, in accordance with our clients’ brief, we shall continue to provide this service to those entities that have not as yet complied with the PAIA requirements.
